TextFlow License Agreement
YOUR USE OF THIS SERVICE IS SUBJECT TO ALL OF THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS STATEMENT, DO NOT USE THIS SERVICE.
1. The application TextFlow Desktop is protected by copyright law and international copyright treaties.
2. Document conversion of proprietary file formats is not guaranteed to perfectly preserve all elements of a text i.e. layout, WordArt, macros, footnotes/endnotes, etc once the text is exported out of TextFlow into a chosen file format (doc, docx, html, odt etc). If your document contains proprietary elements, we recommend that you take appropriate precautions and process them manually.
3. Documents transferred from users desktop to be processed by the software residing on Nordic River Software AB's servers only for the duration of the session. When analyzed, all documents are irreversibly purged from our servers, and the content of any document is not stored in any retrievable form. All the user's post-analysis work (hereinafter named session) on the document is done locally, is completely separated from any server, and does not require an Internet connection. When the session is over, exporting your work as a doc, docx or HTML document requires a format conversion, which is performed on our servers. After export operations, the resulting document is irreversibly purged from our servers and the document is not stored in any retrievable form. If the Internet connection is cut off during an operation, the document is stored for a time out period of 5 minutes to help maintain the integrity of any working session, and then irrecoverably removed from the server to protect users intellectual property.
4. NORDIC RIVER SOFTWARE AB MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SERVICE, OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SOFTWARE USED ON THIS WEB SERVICE, FOR ANY PURPOSE. THE SOFTWARE SERVICE IS PROVIDED "AS IS" WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. NORDIC RIVER SOFTWARE AB SHALL NOT BE LIABLE UNDER ANY THEORY FOR ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.
5. Title, ownership rights, and intellectual property rights in and to the Software Service shall remain with Nordic River Software AB. You agree to abide by the copyright law and all other applicable laws of Sweden. You acknowledge that the Software in source code form remains a confidential trade secret of Nordic River Software AB and therefore you agree not to modify the Software or attempt to decipher, decompile, disassemble or reverse engineer the Software.
6. NORDIC RIVER SOFTWARE AB SHALL NOT BE LIABLE FOR;
(a) INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE, EVEN IF NORDIC RIVER SOFTWARE AB HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR
(b) FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT THAT APPLICABLE LAW PROHIBITS SUCH LIMITATION.
7. HIGH RISK ACTIVITIES. The Software is not fault-tolerant and is not designed, manufactured or intended for use in critical or hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, or air traffic control systems, in which the failure of the Software could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). Nordic River Software AB specifically disclaims any express or implied warranty of fitness for High Risk Activities.
8. UPDATES. Nordic River may make updates and changes to these terms of use from time to time. Such changes will be posted on our website at www.nordicriver.com., and thereupon will become effective immediately. It is your responsibility to check the website for updates. If you elect not to be in agreement with the new terms of use, you must immediately destroy all copies of TextFlow and inform Nordic River in writing within sixty (60) days of posting.
